Success Guarantee Terms

The success guarantee is a commercial offer provided by Indelib LLC allowing eligible users to request reimbursement of their official theoretical exam fees in case of failure.

This guarantee is optional, not automatic, and subject to the following conditions.

1. Eligibility Requirements

To benefit from the guarantee, the user must:

  • have installed Fahrli before the 1st official exam and kept the application without interruption until the 3rd exam;
  • have used Fahrli at least 3 consecutive days before each of the 3 exams;
  • have reached minimum 90% preparation in the "Training" tab at least once before each attempt (3 times total);
  • have taken the theoretical exam 3 times at an official Swiss test center;
  • hold a valid paid Fahrli access (one-time purchase) subscribed with their own personal App Store/Google Play account.

2. Application Process

The user must send their request to team@fahrli.ch within a maximum of 7 days after their 3rd failure, with:

  • an official proof of failure (scan of ASA result);
  • proof of exam payment;
  • the email address or purchase invoice used for Fahrli;
  • their unique registration number (format FAXXXXXX), found in the settings page;
  • their IBAN, first name, last name, and postal code.

Incomplete or late requests cannot be processed.

3. Reimbursement Amount

The reimbursement covers only the official registration fees for the theoretical exam for category B, A, or A1 (amount charged by the cantonal authority). Fahrli purchase fees are not refundable.

4. Exclusions

The guarantee does not apply if:

  • the exam was interrupted or cancelled due to the candidate's fault;
  • the user missed an appointment or showed up without valid identification;
  • the conditions in Article 1 are not strictly met.

5. Processing Time

Subject to validation, the reimbursement will be made within a maximum of 30 days via bank transfer.

6. Modifications

Indelib reserves the right to modify or suspend the guarantee at any time, with no retroactive effect on already eligible users.

7. Authoritative Language

This text exists in French, German, English, and Italian. In case of interpretation discrepancy, the French version prevails.

8. Applicable Law and Jurisdiction

These terms are governed by Swiss law.

In case of dispute, the parties agree to seek an amicable solution. Failing that, exclusive jurisdiction lies with the ordinary courts of the consumer's domicile in Switzerland (Art. 32 CPC).

For users outside Switzerland, the exclusive jurisdiction is Geneva.

9. Data Protection

The data collected (IBAN, last name, first name, email, postal code) are processed only for the purpose of handling the reimbursement request, in accordance with our Privacy Policy and the Federal Data Protection Act (FDPA).

They are retained for 12 months for accounting purposes and then deleted. The user has the right to access, rectify, and delete their data by writing to team@fahrli.ch.

10. Severability

If any clause of these terms is deemed invalid, the other clauses remain fully applicable.

11. Authoritative Language

This policy exists in French, German, English, and Italian. In case of interpretation discrepancy, the French version prevails.
