Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter "T&C") govern the purchase of paid access to the Fahrli platform via the mobile application (iOS and Android).

1. Purpose and Scope

1.1 Purpose

These T&C define the conditions of sale for unlimited paid access to the Fahrli application, an educational platform for preparation of the Swiss theoretical driving license exam.

1.2 Scope

These T&C apply exclusively to purchases made via:

  • Apple App Store (for iOS devices)
  • Google Play Store (for Android devices)

No sales are possible via the website https://fahrli.ch, which serves informational purposes only.

1.3 Acceptance

Any purchase implies full and complete acceptance of these T&C as well as the Terms of Use (ToU) of Fahrli.

The buyer acknowledges having read these conditions before proceeding with payment.


2. Product Offered

2.1 Description

Fahrli offers a one-time purchase providing access to:

  • the entire practice question database
  • all thematic learning modules
  • the complete progress tracking system
  • the AI conversational assistant (subject to availability)
  • all premium application features

2.2 Access Duration

The one-time purchase grants unlimited lifetime access to Fahrli's paid content, subject to:

  • continuation of the service by Indelib
  • user compliance with the Terms of Use

"Lifetime" means: as long as the Fahrli service is in operation and the user complies with the ToU.

2.3 Content Evolution

Indelib reserves the right to:

  • add new features (included at no extra cost)
  • update educational content
  • modify the user interface
  • update technologies used

Users who made a one-time purchase benefit automatically and free of charge from all improvements made to the service.


3. Price and Payment Terms

3.1 Sale Price

The price for unlimited access to Fahrli is displayed in Swiss francs (CHF) in the App Store or Play Store at the time of purchase.

Reference price: CHF 16.95 (one-time purchase)

3.2 Price Variability

Indelib reserves the right to modify the sale price at any time for:

  • temporary promotional operations
  • pricing optimization tests (A/B testing)
  • adaptation to market conditions

The applicable price is that displayed at the time of purchase validation. Users who have already made a purchase are not affected by subsequent price changes.

3.3 Payment Methods

Payment is processed exclusively by:

  • Apple Inc. (for iOS purchases via the App Store)
  • Google LLC (for Android purchases via the Play Store)

Indelib does not directly collect or process payments. Accepted payment methods are those offered by Apple and Google (credit card, PayPal, App Store/Play Store credit, etc.).

3.4 Payment Security

Transactions are secured by Apple's and Google's payment systems. Indelib never has access to users' banking data (card number, banking details, etc.).

3.5 Invoice

An electronic invoice is automatically issued by Apple or Google after each purchase. Users can view it in their App Store or Play Store account.

Indelib does not issue invoices directly, except upon specific request for administrative purposes. In this case, contact team@fahrli.ch.


4. Purchase and Activation Process

4.1 Purchase Steps

  1. The user downloads the Fahrli application (free) on the App Store or Play Store
  2. They use the limited free version
  3. They select the "Buy full access" option
  4. They are redirected to the Apple or Google payment system
  5. They validate the purchase according to their App Store/Play Store account terms
  6. Unlimited access is activated immediately after payment confirmation

4.2 Instant Activation

Paid access is activated automatically and immediately upon payment validation by Apple or Google.

The user can start using all premium features without waiting time.

4.3 Multi-device

The purchase is linked to the user's Apple Account (Apple ID) or Google Account.

They can restore their paid access on all devices connected to the same account (iPhone, iPad, Android, etc.) via the "Restore purchases" function in the application.

4.4 Device Change

In case of device change (new phone, new tablet), the user retains their access by:

  • logging in with the same Apple ID or Google Account
  • using the "Restore purchases" function in Fahrli

Warning: Changing operating system (iOS to Android or vice versa) does not allow purchase transfer. The purchase is tied to the platform (Apple or Google).


5. Right of Withdrawal

5.1 Legal Principle

In accordance with Article 40a of the Swiss Code of Obligations (CO), the buyer has a 14-day period to withdraw without justification.

5.2 Exception for Digital Content

However, for digital content delivered immediately (Art. 40e CO), the right of withdrawal is excluded if:

  • the buyer has expressly consented to immediate delivery
  • contract performance began before the withdrawal period ended

5.3 Application to Fahrli

Since paid access to Fahrli is activated immediately after purchase and the user has expressly requested this activation, the 14-day right of withdrawal does not apply.

By proceeding with the purchase, the user acknowledges and accepts:

  • that premium access is granted immediately
  • that they thereby waive their 14-day right of withdrawal

5.4 Exceptional Refunds

Despite the exclusion of the right of withdrawal, the user may request a refund according to Apple's and Google's refund policies (see Article 6).


6. Refunds and Cancellations

6.1 Apple and Google Jurisdiction

Refund requests must be addressed directly to Apple or Google, which apply their own refund policies.

Indelib cannot directly process refund requests for purchases made via the App Store or Play Store.

6.2 Refund Procedures

For iOS purchases (Apple App Store):

  1. Go to https://reportaproblem.apple.com
  2. Log in with your Apple ID
  3. Select the Fahrli purchase
  4. Request a refund explaining the reason

For Android purchases (Google Play Store):

  1. Access https://play.google.com/store/account
  2. Select "Order history"
  3. Find the Fahrli purchase
  4. Click "Request a refund"

6.3 Refund Timelines

  • Apple: generally within 48h if the request is accepted (Apple policy)
  • Google: generally within 15 minutes to 4 days depending on cases (Google policy)

Indelib has no control over these timelines which depend exclusively on Apple and Google.

6.4 Refund Conditions

Conditions for accepting a refund are defined by Apple and Google. Generally, a refund may be granted if:

  • the purchase was made by mistake
  • the application does not work properly (major bug)
  • the content does not match the description
  • the request is made within a reasonable timeframe (generally 48h to 7 days depending on platform)

Indelib strongly recommends trying Fahrli's free version before purchasing full access to avoid disappointment.

6.5 Refund Consequences

If a refund is granted by Apple or Google:

  • paid access to Fahrli is immediately revoked
  • the user returns to the limited free version
  • progress data is retained but access to premium content is blocked

6.6 Indelib Assistance

If you encounter difficulties obtaining a refund from Apple or Google, you can contact Indelib at team@fahrli.ch.

Indelib will do its best to assist the user, but cannot guarantee obtaining a refund, as this decision is solely up to Apple or Google.


7. Warranties

7.1 Warranty of Conformity

Indelib warrants that Fahrli functions in accordance with the description provided on the App Store, Play Store, and fahrli.ch website.

In case of lack of conformity (major bug, advertised feature not available), the user may:

  1. Report the problem to team@fahrli.ch
  2. Request correction within a reasonable timeframe
  3. If correction is not possible, request a refund from Apple or Google

7.2 Warranty Against Hidden Defects

In accordance with Articles 197 and following of the Swiss Code of Obligations (CO), Indelib warrants Fahrli against hidden defects that would significantly diminish its value or fitness for use.

The claim period is 2 years from discovery of the defect.

7.3 Warranty Limitations

Indelib does not warrant:

  • the total absence of minor bugs or non-critical errors
  • operation on obsolete or incompatible devices
  • compatibility with modified operating system versions (jailbreak, root)
  • the user's success on the official theoretical exam

7.4 Obligation of Means

Indelib commits to implementing all necessary means to provide a quality service, but cannot guarantee a specific result (notably exam success).


8. Liability

8.1 Indelib's Liability

Indelib is liable for proven direct damages resulting from intentional fault or gross negligence in providing the Fahrli service.

8.2 Liability Exclusion

Indelib cannot be held liable for:

  • the user's failure on the official theoretical exam
  • indirect damages (loss of time, loss of opportunity, moral prejudice)
  • malfunctions related to the user's device or Internet connection
  • errors in educational content, except proven gross fault
  • decisions made by Apple or Google regarding refunds

8.3 Liability Limitation

Within the limits allowed by Swiss law, Indelib's total liability cannot exceed the amount paid by the user for purchasing access to Fahrli.

8.4 Force Majeure

Indelib cannot be held liable for non-performance of its obligations in cases of force majeure (natural disaster, pandemic, major cyberattack, infrastructure failure, etc.).


9. Permanent Service Discontinuation

9.1 Notice

Indelib reserves the right to permanently cease Fahrli operation with at least 30 days' notice communicated via:

  • notification in the application
  • email (if address was provided)
  • publication on the fahrli.ch website

10. Intellectual Property

All Fahrli content is protected by copyright. The conditions for using this content are defined in Fahrli's Terms of Use (ToU).

Purchasing paid access does not grant any ownership rights to Fahrli's content, but only a personal use license in accordance with the ToU.


11. Personal Data

Processing of personal data in connection with the purchase and use of Fahrli is governed by our Privacy Policy, compliant with the Federal Data Protection Act (nFDPA).

Indelib does not collect banking data, which is processed exclusively by Apple and Google according to their own privacy policies.


12. Modifications to T&C

12.1 Right to Modify

Indelib reserves the right to modify these T&C at any time to:

  • comply with legal or regulatory changes
  • adapt conditions to service developments
  • clarify certain provisions

12.2 Notification

Substantial modifications will be brought to users' attention by:

  • notification in the application
  • publication on the fahrli.ch website

12.3 Non-Retroactivity

Modifications do not apply retroactively to purchases already made, except for mandatory legal provisions.

Users who made a purchase before the modification remain subject to the T&C in effect at the time of their purchase, except for clauses made mandatory by law.


13. Applicable Law and Jurisdiction

13.1 Applicable Law

These T&C are governed by Swiss law, notably:

  • the Code of Obligations (CO)
  • the Unfair Competition Act (UCA)
  • the Federal Data Protection Act (nFDPA)

13.2 Dispute Resolution

In case of dispute, the parties undertake to seek an amicable solution before any legal action.

The user may contact Indelib at team@fahrli.ch.

13.3 Competent Jurisdiction

Failing amicable agreement, the ordinary courts of the buyer's domicile in Switzerland have jurisdiction (Art. 32 CPC - consumer protection).

For buyers located outside Switzerland, the exclusive jurisdiction is the Canton of Geneva.

13.4 Mediation

In case of dispute with Apple or Google regarding a refund, the user may also contact mediation services.


14. Authoritative Language

These T&C exist in French, German, English, and Italian. In case of interpretation discrepancy, the French version prevails.
